حذف آگهی‌های دولتی از مطبوعات در شرایطی که روزنامه ها این روزها به سختی ادامه حیات می دهند، موضوعی است که «نگرانی جدی و گسترده‌ای را در میان اصحاب مطبوعات و رسانه» ایجاد کرده است. وزیر ارشاد هم با جانبداری از اهالی رسانه، در نامه ای به معاون اول رییس جمهور این اقدام را به منزله «زنگ خطر نهایی برای مطبوعات کشور» قلمداد کرده و خواستار آن شده است که «این مصوبه با قید فوریت و خارج از نوبت در دستور کار هیات دولت قرار گیرد».
به گزارش مردم گلستان، پدرام پاک آیین، نماینده مدیران مسئول در هیات نظارت بر مطبوعات از جمله افرادی بود که نسبت به این آیین‌نامه واکنش نشان داده و آن منتج به «مرگ مطبوعات مظلوم و مستقل کشور » دانسته است.
او در نامه‌ای به رییس جمهوری با یادآوری شرایط دشوار مطبوعات کشور، خواستار لغو آیین‌نامه نحوه فعالیت دستگاه‌های اجرایی در سامانه تدارکات الکترونیکی دولت(ستاد) و بازگشت آگهی‌های دولتی به مطبوعات شده است.
در این نامه با استناد به قوانین آیین دادرسی، تجارت و برگزاری مناقصات که درج آگهی‌های دولتی را در مطبوعات الزام می‌کند، اجرای این تکلیف قانونی، کمکی حداقلی و ضروری به مطبوعات توصیف شده است.
پاک آیین به حسن روحانی نوشته است، «در شرایط دشوار اقتصادی و همه گیری بیماری کرونا چراغ مطبوعات کشور، یکی پس از دیگری خاموش و مطبوعات رفته رفته از سبد خانوار حذف می‌شود. در چنین وضعی از دستگاه های ذیربط انتظار می‌رود تا به وظیفه قانونی خود مبنی بر تامین حداقل‌های زنجیره مالی مطبوعات عمل کنند و با تحرک و دلسوزی بیشتر باری از دوش مطبوعات نجیب و صبور کشور برگیرند.»
او در ادامه نامه به رییس جمهوری آورده است که «ابلاغ آیین نامه نحوه فعالیت دستگاه‌های اجرایی در سامانه تدارکات الکترونیکی دولت (ستاد) که انتشار فراخوان‌ها بر بستر مذکور و حذف آگهی روزنامه برای مزایده‌ها و مناقصه‌ها را مقرر داشته، جامعه مطبوعانی را مأیوس و حیرت زده کرده است. مسبوقید که قوانین متعدد آیین دادرسی، تجارت، برگزاری مناقصات و … درج آگهی های دولتی را در رسانه های چاپی الزام می کند و از قضا این تکلیف قانونی، کمکی حداقلی و ضروری به جامعه مطبوعات است.
تصدیق می‌فرمایید که مطبوعات به عنوان جریان اصیل و رسمی اطلاع رسانی از مرزهای اعتقادی و آرمانی ملت بزرگ ایران در برابر تهاجم دستگاه تبلیغانی دشمن صیانت می کنند و از این رو حمایت و اعتماد نسبت به آنها به ویژه نشریات استانی و شهرستانی، ضرورتی اجتناب ناپذیر است.»
نماینده مدیران مسئول در هیات نظارت بر مطبوعات در پایان نامه خود درخواست کرده است، «بنا به توضیحات فوق خواهشمند است مصوبه مورد اشاره را که به مرگ مطبوعات مظلوم و مستقل کشور می انجامد، لغو و کان لم یکن اعلام فرمایید.»
در این میان عباس صالحی، وزیر فرهنگ و ارشاد اسلامی نیز با انتشار پیامی درباره این آیین نامه اظهار نظر کرد و نوشت، «آیین نامه ابلاغی ستاد موجب نگرانی جدی مطبوعات شد. با توجه به اینکه در زمان عدم حضور اینجانب و در خارج از نوبت در هیات دولت مطرح شده بود، با جناب آقای دکتر جهانگیری صحبت کردم و با نظر مساعد ایشان قرار شد که با درخواست اصلاحیه در ماده مربوطه، مجددا در جلسه چهارشنبه مطرح شود.»
وزیر ارشاد همچنین در نامه ای به اسحاق جهانگیری ـ معاون اول رئیس جمهور ـ که دقایقی قبل رسانه ای شد، نوشت: این مصوبه زنگ خطر نهایی برای مطبوعات کشور بوده و نگرانی جدی و گسترده‌ای در میان اصحاب مطبوعات و رسانه ایجاد کرده است.
در متن نامه سید عباس صالحی درباره مصوبه حذف الزام دولتی‌ها به انتشار آگهی در روزنامه‌ها آمده است:
«همانگونه که مستحضر هستید هیات وزیران به موجب ماده (۱۴) مصوبه شماره ۱۳۶۱۵۹/ت ۰۵۵۲۸۹ مورخ ۲۵ /۱۱ /۹۹ تحت عنوان «آئین‌نامه نحوه فعالیت دستگاه‌های اجرایی در سامانه تدارکات الکترونیکی دولت» مقرر نموده است «در اجرای ماده (۵۰) قانون احکام دایمی برنامه‌های توسعه کشور مبنی بر انجام تمامی مراحل برگزاری معاملات دستگاه‌های اجرایی به صورت الکترونیکی، انتشار دو تا سه نوبت فراخوان موضوع بند(ب) ماده(۱۳) قانون برگزاری مناقصات صرفا به صورت الکترونیکی از طریق ستاد معتبر و مکفی و مورد پذیرش می‌باشد و باید از انجام آن به کاغذ خودداری گردد».
در ارتباط با مصوبه فوق نکات زیر مطرح است:
۱_ آئین‌نامه یاد شده، اصولا برای بررسی و اظهارنظر کارشناسی و حضور در کمیسیون مربوطه به وزارت فرهنگ و ارشاد اسلامی ارجاع نگردیده است. با آنکه در تمامی موارد به ویژه ماده ۱۴ اخذ نظرات این وزارتخانه ضروری بوده است.
۲_ در جلسه یکشنبه مورخه ۱۵ بهمن، اینجانب دو ساعت اولیه جلسه را حضور داشتم و به واسطه برنامه‌های جشنواره‌های فجر، جلسه را زودتر ترک کردم. آئین‌نامه فوق در ساعت پایانی مطرح شد با آنکه در دستور جلسه، موضوعات متعددی قبل از آن مطرح بود، مطمئنا ترتیب رعایت می‌شد نوبت به این دستور نمی‌رسید!
۳_ مصوبه فوق الذکر، نگرانی جدی و گسترده‌ای را در میان اصحاب مطبوعات و رسانه ایجاد کرده است، چه اینکه در شرایط جاری سخت و عسرت اصحاب رسانه، می‌تواند زنگ خطر نهایی برای مطبوعات کشور باشد.
۴_ ماده ۵۰ قانون احکام دایمی برنامه‌های توسعه بر رعایت قانون برگزاری مناقصات تاکید می‌کند و هیچ صراحتی در خصوص عدم انتشار فراخوان در روزنامه‌های کثیرالانتشار ندارد.»
وزیر فرهنگ و ارشاد اسلامی در بخش دیگری از این نامه یادآور شده است:
۵_ ماده ۱۴ مصوبه یاد شده، با قوانین زیر مغایرت روشنی دارد:
۱/۵_ قانون مربوط به نشر آگهی‌های دولتی مصوب ۱۳/۰۴/۱۳۳۶ با اصلاحات بعدی:
به موجب ماده (۱) این قانون «از تاریخ تصویب این لایحه قانونی وزارتخانه‌ها و سازمان برنامه و بنگاه راه‌آهن و بانک‌ها و سایر بنگاه‌های دولتی و موسسات و شرکت‌هایی که به سرمایه دولت اداره می‌شوند مکلفند کلیه آگهی‌های دولتی را برای درج در جراید مستقیما به اداره کل انتشارات و تبلیغات ارسال دارند و همچنین آگهی‌هایی که به هزینه اشخاص باید به وسیله دولت منتشر شود».
۲/۵_ بند «۵» ماده (۲) قانون اهداف و وظایف وزارت فرهنگ و ارشاد اسلامی که مقرر داشته: «اجرای قوانین مربوط به مطبوعات و نشریات و تعیین ضوابط و مقررات مربوطه و تمرکز، توزیع و نشر انواع آگهی‌های دولتی و اجرای آن در داخل و خارج کشور.»
۳/۵_ الزام به چاپ آگهی‌های دادگستری در روزنامه‌های کثیرالانتشار:
_ مواد (۲۱۰) و (۳۴۳) قانون امور حسبی
_ مواد (۱۷۴)، (۳۴۴)، (۳۹۴) و (۶۱۶) قانون آیین دادسری کیفری
۴/۵_ ماده (۱۳) قانون برگزاری مناقصات مصوب ۰۳/۱۱/۱۳۸۳ مجمع تشخیص مصلحت نظام:
«ب_ فراخوان مناقصه عمومی باید به تشخیص مناقصه گزار در دو تا سه نوبت حداقل در یکی از روزنامه‌های کثیرالانتشار کشوری یا استان مربوط منتشر گردد.»
۵/۵_ بند (ج) ماده (۱۱) قانون برگزاری مناقصات:
ج_ در معاملات بزرگ به یکی از روش‌های زیر عمل می‌شود:
۱_ برگزاری مناقصه عمومی از طریق انتشار فراخوان در روزنامه‌های کثیرالانتشار.
۲_ برگزاری مناقصه محدود
با عنایت به مراتب یاد شده خواهشمند است دستور فرمائید اصلاح مصوبه پیش گفته هیات محترم وزیران برابر قوانین یاد شده با فوریت و خارج از نوبت در دستور کار هیات محترم وزیران قرار گیرد.
پیشاپیش از بذل مساعدت که داشته و دارید سپاسگزارم.»
از سوی دیگر محمد خدادی، معاون امور مطبوعاتی وزیر فرهنگ و ارشاد اسلامی، نیز به انتشار یک توئیت در این زمینه بسنده و چنین عنوان کرده که موضوع مصوب شده در هیات دولت در مورد آگهی دستگاه‌ها، بدون اطلاع معاونت تخصصی بوده است!
متن کامل این توئیت به این شرح است: «جهت اطلاع: موضوع مطرح و مصوب شده در هیات دولت در مورد آگهی دستگاه‌ها بدون اطلاع معاونت تخصصی بوده! طبیعتا وظیفه معاونت مطبوعاتی وزارت فرهنگ و وزیر محترم پیگیری و حل موضوع به نفع رسانه‌ها است که در حال انجام است. انتظار هم افزایی و همکاری برای حل مساله درون خانواده رسانه را دارم.»
